                   	     ORDINANCE NO. 9462
                  
                  
                   AN ORDINANCE CLOSING AND ABANDONING A PORTION
                   OF WALNUT STREET, MILL STREET AND AN ALLEY,
                   LOCATED SOUTHWEST OF NORTH WILDER STREET,
                   NORTHWEST OF PINE STREET, MORE PARTICULARLY
                   DESCRIBED HEREIN, UPON CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned a portion of Walnut Street, Mill Street, and an
         alley, located southwest of North Wilder Street, northwest of 
Pine
         Street, more particularly described herein, and as shown on 
plat
         attached hereto and made a part hereof by reference:
               
                Walnut Street, a 60 foot wide unopened right-of-way
                beginning on the southwest line of North Wilder
                Street 500 feet northwest of the intersection of
                the southwest line of North Wilder Street with the
                northwest line of Pine Street, and extending
                southwest some 423 feet between parallel lines to
                the southwest line of Mill Street.  Said street
                separates lots 13 and 14, block 1, from lots 1 and
                20, block 2, Town of King's Point, as shown by plat
                of record in deed book P, volume 2, page 76, 77
                and 78, R.O.H.C.
               
                Mill Street, an unopened right-of-way some 30 feet
                wide beginning on the northwest line of Walnut
                Street (unopened) some 393 feet southwest of the
                intersection of the northwest line of Walnut Street
                with the southwest line of North Wilder Street, and
                extending southeast 510 feet between parallel lines
                to the southeast line (if extended southwest) of
                lot 12, block 2, Town of King's Point, as shown by
                plat of record in deed book P, volume 2, page 76,
                77 and 78, R.O.H.C.  Said street separates lots
                12-20, block 2, said Town of King's Point, from an
                unplatted tract.
               
                An unopened alleyway some 25 feet wide beginning on
                the southeast line of Walnut Street (unopened) 184
                feet southwest of the intersection of the southeast
                line of Walnut Street with the southwest line of
                North Wilder Street, and extending southeast 500
                feet between parallel lines to the northwest line
                of Pine Street (unopened).  Said alleyway separates
                lots 1-10 from lots 11-20, block 2, Town of King's
                Point as shown by plat of record in deed book P,
                volume 2, page 76-78, R.O.H.C.
               
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:
              1.   The Electric Power Board of Chattanooga has
                   distribution facilities located within said
                   rights-of-way which must be maintained for the use
                   and benefit of its customers and an easement the
                   width of the entire rights-of-way is reserved for
                   the operation, maintenance, rebuilding, and
                   replacement of these distribution facilities.
             
              2.   The City of Chattanooga has a sewer located within
                   a portion of the right-of-way of Walnut Street and
                   reserves an easement the width of the right-of-way
                   for the purpose of maintaining said sewer.
             
              3.   The areas reserved for the above easements shall be
                   kept free and clear of all structures.
             
              4.   Resubdivision of subject property to avoid any
                   landlocked lots.
             
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this
         Ordinance shall take effect two weeks from and after its 
passage
         as provided by law, provided, however, that this Ordinance 
shall
         not be operative until completion of condition no. 4 in Section 

         2 above.
